a) ORDINANCE NO. 17-07
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH DAYTONA, FLORIDA REPEALING ORDINANCE 16-10 WHICH ESTABLISHED A TWELVE MONTH MORATORIUM ON THE GROWING, PROCESSING, MANUFACTURING, DISTRIBUTING, DISPENSING AND SELLING OF MEDICAL MARIJUANA WITHIN THE CITY LIMITS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. (Tabled during the second reading/public hearing on August 8, 2017)

a) ORDINANCE NO. 17-12
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH DAYTONA, FLORIDA, AMENDING SECTION 10-1.2 TO PROVIDE A WAIVER OF RIGHT TO CONTEST A CITY CITATION AND A PRESUMPTION THAT VIOLATIONS EXIST IF VIOLATOR FAILS TO PAY FINE OR REQUEST SPECIAL MAGISTRATE HEARING; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. Second Reading. Public Hearing. Passed first reading on October 10, 2017.

a) Consideration of renewing a banking contract with Wells Fargo under the terms and conditions as outlined by staff and utilized by Deerfield Beach of which the contract will be “piggybacked” for bidding compliance.

b) RESOLUTION NO. 17-26
A RESOLUTION OF THE CITY OF SOUTH DAYTONA, FLORIDA, APPROVING A LOCAL AGENCY PROGRAM SUPPLEMENTAL AGREEMENT FOR THE BIG TREE ROAD SHARED USE PATH WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT; PROVIDING FOR REPEAL OF RESOLUTION IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. First and only reading.

c) RESOLUTION NO. 17-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH DAYTONA, FLORIDA AUTHORIZING ENTERING INTO A LOAN AGREEMENT WITH COMPASS BANK IN AN AMOUNT NOT TO EXCEED $1,000,000 FOR THE PURPOSE OF FINANCING THE COSTS AND EXPENSES ASSOCIATED WITH CLEAN-UP AND RECONSTRUCTIVE EFFORTS RELATED TO HURRICANE IRMA AS DESCRIBED HEREIN AND PAYING COSTS RELATED THERETO; PROVIDING THAT OBLIGATIONS UNDER THE LOAN AGREEMENT AND THE NOTE SHALL BE A LIMITED OBLIGATION OF THE CITY PAYABLE FROM REIMBURSEMENT FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY AND OTHER STATE OR FEDERAL AGENCIES, AND A SUBORDINATE LIEN ON THE NET REVENUES OF THE CITY’S WATER AND SEWER SYSTEM AS PROVIDED HEREIN; PROVIDING FOR THE RIGHTS, SECURITIES AND REMEDIES FOR THE LENDER; AUTHORIZING THE PRIVATE NEGOTIATED DIRECT PLACEMENT OF THE LOAN WITH THE LENDER PURSUANT TO THE TERMS AND CONDITIONS DESCRIBED HEREIN; APPROVING THE FORM OF THE LOAN AGREEMENT AND THE NOTE; MAKING SUCH DETERMINATIONS AS ARE REQUIRED TO AFFORD THE NOTE “BANK QUALIFIED” STATUS; AUTHORIZING OTHER REQUIRED ACTIONS; AND PROVIDING AN EFFECTIVE DATE. d) EMERGENCY ORDINANCE NO. 17-11
AN EMERGENCY ORDINANCE OF THE CITY OF SOUTH DAYTONA, FLORIDA, AMENDING ORDINANCE 17-04, SETTING FORTH APPROPRIATION FOR REVENUES, EXPENSES AND CAPITAL OUTLAY FOR THE FOLLOWING FUNDS: GENERAL FUND, POLICE CONFISCATED FUND, TRANSPORTATION FUND, UTILITY SERVICE FUND AND INTERSERVICE FUND, AS REQUIRED BY THE CITY OF SOUTH DAYTONA, FLORIDA, DURING AND FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2016 AND ENDING SEPTEMBER 30, 2017; ADOPTING THE OPERATING AND CAPITAL BUDGETS FOR THE CITY OF SOUTH DAYTONA; PROVIDING FOR SEVERANCE; PROVIDING FOR CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. First and only reading.

e) ORDINANCE NO. 17-13
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH DAYTONA, FLORIDA, BY AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE VA. ELECTIONS, CREATING A NEW SECTION 2-175 (CAMPAIGN TREASURER’S REPORTS - ELECTRONIC CAMPAIGN FILING) OF THE CITY CODE OF ORDINANCES REQUIRING FILING OF CAMPAIGN TREASURER’S REPORTS WITH THE VOLUSIA COUNTY SUPERVISOR OF ELECTIONS OFFICE’S ELECTRONIC FILING SYSTEM; PROVIDING FOR CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. First Reading.

f) ORDINANCE NO. 17-14
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH DAYTONA, FLORIDA ADOPTING A SIX (6) MONTH MORATORIUM ON LOCATING WIRELESS COMMUNICATIONS FACILITIES INCLUDING SMALL WIRELESS FACILITIES IN A PUBLIC RIGHT OF WAY WITHIN THE CITY LIMITS AND ESTABLISHING THE FEE FOR COLLOCATING ON CITY-OWNED UTILITY POLES AT THE MAXIMUM RATE ALLOWED BY LAW; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. First reading.
